DMCA & Intellectual Property Policy

Encelade respects the intellectual property rights of others and expects our users to do the same. This policy describes how we handle claims of copyright infringement in accordance with the Digital Millennium Copyright Act ("DMCA") and other applicable intellectual property laws.
1. Reporting Copyright Infringement
If you believe that content hosted on or generated through the Encelade Service infringes your copyright, you may submit a DMCA takedown notice to our designated agent. Your notice must include:
- A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.
- Identification of the copyrighted work claimed to have been infringed.
- Identification of the material that is claimed to be infringing, and information reasonably sufficient to permit us to locate the material (e.g., a URL or description).
- Your contact information, including name, address, telephone number, and email address.
- A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
- A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the copyright owner.

3. Counter-Notification
If you believe that your content was removed or disabled by mistake or misidentification, you may submit a counter-notification. Your counter-notification must include:
- Your physical or electronic signature.
- Identification of the material that was removed and the location at which it appeared before removal.
- A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.
- Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the courts located in Paris, France, and that you will accept service of process from the person who provided the original notice.
Upon receiving a valid counter-notification, we will forward it to the original complainant. If the complainant does not file a court action within 10 business days, we may restore the removed material.
4. Repeat Infringers
In accordance with the DMCA and other applicable law, we maintain a policy of terminating, in appropriate circumstances, accounts of users who are deemed to be repeat infringers. We may also, at our sole discretion, limit access to the Service or terminate the account of any user who infringes any intellectual property rights of others, whether or not there is any repeat infringement.

If you believe that content on the Service infringes your trademark rights, please contact us at legal@encelade.app with a description of the alleged infringement. We will review and respond to valid trademark complaints in accordance with applicable law.
6. AI-Generated Content
We acknowledge that AI-generated content may unintentionally reproduce elements that resemble existing copyrighted works. If you believe that AI Output generated through our Service infringes your intellectual property, please follow the same reporting process described above. We will investigate and take appropriate action.
